Attorneys Steve Cornelius and Mustafa Salameh prevailed on a preliminary Motion to Dismiss and/or for Summary Judgment on behalf of a local law firm based in Anne Arundel County. In the case, the plaintiff accused the law firm’s principal of having made negligent and intentional misrepresentations that were purportedly relied upon by the plaintiff to her detriment.
Attorneys Cornelius and Salameh successfully argued that the legal defendants were not culpable, and that plaintiff failed to state a claim upon which relief can be granted. In doing so, they demonstrated (i) that the legal defendants did not owe any duty to the plaintiff, (ii) that the plaintiff did not rely upon statements by the legal defendants, and (iii) that the plaintiff did not sustain any damages as a result of such reliance. They also reemphasized Maryland precedent recognizing that the Maryland Rules of Professional Conduct (MRPC) are designed “to provide a structure for regulating conduct through disciplinary agencies. They are not designed to be a basis for civil liability.”
